SMS Program Terms
These terms govern the text message program operated through PoliteDue ("PoliteDue", "we", "us"). They apply to anyone who receives a PoliteDue-powered message, and to every customer who sends one. They are written to be read by the people receiving the messages — not only by lawyers.
| Program name | PoliteDue Payment Reminders |
|---|---|
| Message types | Transactional payment reminders for invoices already issued to you by the sender. No marketing, no promotions. |
| Who sends | The business you already work with (your client's own company), using PoliteDue as software. PoliteDue is not a collection agency. |
| Message frequency | Varies. Typically 1–3 messages per unpaid invoice; never more than 1 per invoice per day. |
| Cost | Message and data rates may apply, depending on your mobile plan. PoliteDue never charges recipients. |
| Opt out | Reply STOP at any time. One message confirms the opt-out, then messages stop. |
| Help | Reply HELP, or email [email protected]. |
| Number sharing | We never sell, rent, or share mobile numbers or opt-in consent with third parties or affiliates. |
1. What this program is — and what it is not
PoliteDue is payment reminder software used by freelancers and small businesses to remind their own clients about invoices that are already overdue. The debt exists between you and the sender. PoliteDue is the tool that delivers the reminder; PoliteDue is not a party to the invoice and does not collect debts on behalf of third parties.
The one-sentence version: if you receive a PoliteDue-powered text, it comes from a business you already have an account or engagement with, about an invoice they already sent you. Nothing else.
We do not operate a debt-collection service, we do not buy or sell debts, and we do not send messages on behalf of parties unknown to you. Our customers must attest, before their first message is delivered, that they have an existing business relationship with each recipient and that they have obtained the recipient's consent to be contacted at that number.
2. Who receives messages
Messages go only to people who:
- are an existing client or customer of the business sending the message, and
- have provided that mobile number to the sending business in the course of that relationship — for example on an invoice, a contract, or a project intake form — and
- have given consent to receive text messages at that number, as described in section 3.
We do not send messages to purchased lists, scraped numbers, or people with no prior relationship to the sender. Cold texting is a prohibited use of PoliteDue.
3. How consent is obtained (opt-in)
Consent is collected by the sending business — the party with the existing relationship — and recorded in PoliteDue at the moment the recipient's number is added. Before a number can receive its first message, the sender must certify all of the following in the product:
- the recipient is an existing client or customer of the sender;
- the recipient provided this mobile number directly to the sender;
- the recipient has agreed to receive payment-related text messages at this number;
- the sender will honor opt-outs immediately and will not re-add a number that has opted out.
This certification, together with a timestamp, the opt-in source, and the message history, is retained as a record of consent. Opt-in is never a condition of purchasing goods or services.
4. Message types and frequency
Messages are transactional and informational only. They concern invoices the sender already issued to you. Typical content includes a reminder that an invoice is due, that it is past due, a payment link the sender has provided, and a way to reply or ask a question.
We do not send marketing, promotional, or advertising content through this program. Message frequency varies with how many invoices are outstanding: typically one to three messages per unpaid invoice, and never more than one message per invoice per day. Automated sending respects quiet hours and local-time delivery windows configured by the sender.
5. Cost to recipients
Message and data rates may apply. PoliteDue does not charge recipients for receiving messages. Any charges come from your mobile carrier under your own plan. The sending business pays for the messages it sends.
6. Opting out and getting help
You can stop messages from a sender at any time:
- Reply
STOPto any message. You will receive one confirmation message, and no further messages from that sender. - Reply
HELPfor program information, or email [email protected]. - Ask the sending business directly to stop, and they can disable messaging for your number in PoliteDue.
Opt-outs are honored immediately and are recorded. Neither the sending business nor PoliteDue will re-add a number that has opted out. Standard carrier commands STOP, END, CANCEL, UNSUBSCRIBE, QUIT, HELP, and INFO are all recognized.
7. Your mobile number is never sold or shared
Mobile numbers, opt-in records, and consent data collected through this program are never sold, rented, shared, or disclosed to third parties or affiliates for any purpose, including marketing. They are used solely to deliver the messages you agreed to receive. The only parties with access are (a) the sending business, for its own client communications, and (b) our messaging infrastructure provider, which processes delivery on our instructions as a service provider. This section is a material term of this program and is not subject to change without notice to you.
8. Sender identity in every message
Every message identifies the sending business, so you always know who is contacting you and why. PoliteDue does not send anonymous messages, does not hide the sender behind a generic short code, and does not impersonate anyone.
9. Delivery and carriers
Messages are delivered through mobile carriers and are subject to their systems and policies. Delivery is not guaranteed and may be delayed or blocked by carriers, device settings, or coverage. Carriers are not liable for delayed or undelivered messages. PoliteDue is not responsible for carrier-side filtering decisions.
10. Changes to this program
If we change material terms of this program — message types, frequency, or how consent and opt-out work — we will update this page and revise the date above. Continued receipt of messages after a change means you accept the updated terms; you may opt out at any time as described in section 6.
